These Terms of Service (“Terms”) apply to the digital services available on the kiddos.games website (the “Website”), operated for the international market. By placing an order you accept these Terms.

Matters not regulated in these Terms are governed by Hungarian law, in particular the Civil Code (Act V of 2013), Act CVIII of 2001 on electronic commerce, Government Decree 45/2014 (II. 26.) on contracts between consumers and businesses, and Government Decree 373/2021 (VI. 30.) on the conformity of digital content and digital services. The latter two implement Directive 2011/83/EU on consumer rights and Directive (EU) 2019/770 on digital content into Hungarian law.
Where the customer is a consumer habitually resident in another EEA state, this choice of law does not deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of residence.
II. Nature of the service, technical requirements
The Provider offers a recurring Premium membership granting access, for the duration of the paid subscription period, to playful educational online content and digital materials for children aged approximately 4–10.
Minimum technical requirements:
- a device with an internet connection (computer, tablet or smartphone);
- an up-to-date browser (current version of Chrome, Firefox, Edge or Safari);
- a stable internet connection for online content and interactive interfaces;
- an e-mail address to receive access details.
It is the customer’s responsibility to ensure that their device meets these requirements. The Provider is not liable for faults caused by an unsuitable device or connection.
III. Ordering, prices, payment, correction of errors
The customer selects the subscription plan on the Website and completes the order form. Entered data (name, e-mail, billing details) can be reviewed on the order summary page; input errors can be corrected before the order is finalised.
By pressing the “Subscribe” button the customer places an order carrying an obligation to pay and accepts these Terms.

All prices are shown in euro and are the total amount charged; no additional charges are added at checkout. Details of the applicable VAT treatment are shown on the invoice.
Automatic renewal and cancellation
- The subscription renews automatically at the end of each billing period, and the fee is charged to the payment method on file, until the customer cancels.
- The customer may cancel at any time, without giving reasons, in their account or by e-mail to hello@kiddos.hu. Cancellation takes effect at the end of the current billing period; access remains available until then.
- Cancellation does not entitle the customer to a refund of the fee already paid for the current period, unless mandatory consumer law provides otherwise.
- The Provider will notify the customer by e-mail at least 30 days in advance of any price increase. The customer may cancel before the change takes effect; continued use after that date constitutes acceptance of the new price.
- If a payment fails, the Provider may retry the charge and may suspend access until payment is completed. If payment is not completed within a reasonable period, the subscription may be terminated.
Payment
- Card payments are processed by Stripe Payments Europe Limited.
- The customer enters card details directly in Stripe’s interface.
- Card details are not transmitted to and cannot be accessed by the Provider.
After successful payment the customer receives an e-mail confirmation and access to the purchased content opens automatically in their user account. If the customer supplied incorrect data (for example a mistyped e-mail address), they must contact the Provider by e-mail so it can be corrected.
Consumers only
Owing to the Hungarian itemised tax regime for small businesses (KATA) under which the Provider operates, the Provider supplies services and issues invoices exclusively to natural persons acting as consumers. Sales to legal persons, sole traders or other business entities are not accepted.
By placing an order the customer declares that they are acting as a private individual and not on behalf of or for the benefit of a legal person or business. If the Provider subsequently learns that the customer was in fact acting for a business, the Provider is entitled to withdraw from the contract and terminate access, deducting the proportionate fee for the service already supplied.
IV. Digital content, right of withdrawal, non-conformity
The services supplied by the Provider qualify as digital content / digital services, to which the customer gains access immediately or shortly after payment.
As a consumer you normally have 14 days to withdraw from a distance contract without giving reasons. However, under Article 16(m) of Directive 2011/83/EU — implemented in Hungary by Section 29(1)(m) of Government Decree 45/2014 (II. 26.) — the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium where:
- performance has begun with the consumer’s prior express consent, and
- the consumer has acknowledged that they thereby lose their right of withdrawal.
When finalising the order the customer expressly declares that they request immediate access to the digital content and acknowledge that they thereby lose the right of withdrawal. If the customer does not give this declaration, access begins after the 14-day period has elapsed.
Conformity and remedies
It constitutes non-conformity in particular if the customer cannot access the purchased digital content in a manner suitable for contractual use (for example it cannot be loaded or played, or is persistently unavailable).
In such a case the customer may request restoration of the service or renewed access. If this is not possible within a reasonable period, the customer may request a proportionate reduction of the price or — in the case of a serious defect — withdraw from the contract.
The Provider is obliged to supply the updates, including security updates, necessary to maintain conformity of the service for the duration specified in the contract.
Faults and complaints can be reported to hello@kiddos.hu, quoting the order identifier and a brief description of the problem.
V. Licence, copyright, trademark
The customer obtains a time-limited, non-exclusive, non-transferable right of use to the purchased digital content, solely for their own personal or educational purposes. The following are prohibited:
- resale, public communication or rental of the content;
- sharing login credentials or access with others;
- copying, uploading or distributing the content on file-sharing services without the Provider’s prior written consent.
All text, image, audio and video material on the Website and in the services is protected by copyright. Intellectual property rights belong to their respective holders. In the event of unauthorised use, the rightholder may claim damages.
Trademark
SmartKiddos® is a trademark registered with the Hungarian Intellectual Property Office under registration number 250 938. The proprietor of the trademark is Pócsik Emese E.V. (8248 Nemesvámos, Kossuth Lajos u. 256., Hungary, tax number: 79299376-1-39). Protection commenced on 7 January 2026. The Provider uses the sign with the proprietor’s permission.
Use of the trademark without permission — including the use of a confusingly similar sign and its inclusion in a domain name, on social media or in a product name — is prohibited and will result in action by the proprietor.
VI. Data protection, complaints, disputes
Personal data on the Website is processed by Dr. Szávuly Miklós István E.V. and Pócsik Emese E.V. as joint controllers under Article 26 GDPR. The details of the processing — including the allocation of responsibilities between them, the categories of data processed and data subject rights — are set out in the separate Privacy Policy available on the Website. By purchasing, the user acknowledges its contents.
Complaints may be addressed to the Provider at hello@kiddos.hu. The Provider will respond without undue delay.
If a complaint cannot be resolved, the consumer may use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, or turn to the conciliation body or consumer protection authority competent at their place of residence. Consumers resident in another EU member state may also seek assistance from the European Consumer Centre in their country.
The contract is governed by Hungarian law and, in the absence of mandatory rules to the contrary applicable to consumer proceedings, Hungarian courts have jurisdiction. This does not affect the consumer’s right to bring proceedings before the courts of their place of residence where mandatory law so provides.
These Terms of Service are effective from 1 September 2026.
